Terms of Use
These terms are an agreement between you and Kova Technologies Ltd (“Kova”, “we”, “us”), a company based in Christchurch, New Zealand. By buying or using Kestrel Journal you accept them. If you do not, please do not use it.
Kestrel Journal is a record-keeping and analysis tool. It is not financial advice. Nothing in the app, the Coach or on our website recommends that you buy, sell or hold anything. Trading carries risk and you can lose money.
1. What you are buying
You pay once for a personal licence to use Kestrel Journal, shown as a licence key we send you after purchase. The price, in US dollars, is the one shown at checkout. Tax is added at checkout where it applies. Updates to the app are included. Coach reviews are paid for separately, in credits, as described below.
2. Your licence
- The licence is for you, for your own trading records, on devices you own or control.
- Do not share, resell or publish your licence key. We may revoke a key that is shared or abused, which ends access to the Coach for that key.
- We keep ownership of the software, the design and the name. You own your own data.
- Do not copy, resell, reverse engineer or try to bypass the licence check, except as the law allows.
3. Payment and merchant of record
Our orders are processed by Lemon Squeezy, who sell Kestrel Journal to you on our behalf as merchant of record. Their terms apply to the payment itself. Refunds are covered by our refund policy.
4. Coach credits
- Each Coach review uses one credit. Every licence includes a small number of starter credits, and you can buy more in packs.
- Credits do not expire. They have no cash value and cannot be transferred.
- The Coach reviews only your closed trades. It does not give financial advice, forecasts or trade ideas. Its output is generated by an AI model and can be wrong, so treat it as one input, not as a verdict.
- To write a review, a summary of your closed trades is sent through our server to Anthropic. See the privacy policy.
5. Your data and backups
Your journal is stored on your own device, in your browser’s storage. We do not hold a copy and cannot recover it for you. Clearing site data, losing a device or changing browsers can remove it. Export a backup file regularly. Sync, where you use it, runs through a folder you choose and not through our servers.
6. Estimates and third-party figures
Figures such as funded-account rule tracking, risk, position size and prices are calculations from what you enter and from third-party data sources. They can be wrong or out of date. A firm’s own dashboard, or your broker’s statement, is always the final word. Check anything important yourself.
7. Availability and changes
We work to keep the app and the Coach running, but we do not promise they will always be available or error free. We may change or improve features over time. The app runs without a connection, apart from the Coach and price refreshes.
8. Liability
To the extent the law allows, the software is provided as it is, and we are not liable for trading losses, lost data or indirect or consequential loss. Our total liability for any claim is limited to the amount you paid us for the licence. Nothing in these terms limits any right you have under New Zealand consumer law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, where they apply to you.
9. Ending the agreement
You can stop using Kestrel Journal at any time. We may end a licence if you break these terms. Your exported data stays yours.
10. Law
These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction.
11. Changes to these terms and contact
If we change these terms in a way that matters, we will update the date at the top of this page. Questions go to support@kestreljournal.com.
